Open AI Responds to Lawsuit By Releasing Emails From Elon Musk

In a recent development, OpenAI has retaliated against Elon Musk, who filed a lawsuit against the ChatGPT company last week, accusing it of prioritizing profits over its original nonprofit mission.

OpenAI released a series of Musk's emails from the early stages of the company, revealing his acknowledgment that substantial funding was crucial for the immense computing resources required to drive its AI initiatives.

The published emails, with some sections redacted, portray Musk's argument that relying solely on fundraising was insufficient for building a successful generative AI platform.

Musk emphasized the necessity of exploring alternative revenue streams for the company's survival. In a November 22, 2015, email to CEO Sam Altman, Musk, a co-founder of OpenAI, proposed a funding commitment exceeding $100 million, suggesting a $1 billion investment and pledging to cover any shortfall.

OpenAI, in a blog post on Tuesday night, asserted that Musk failed to fulfill his commitment, contributing $45 million in funding while other donors raised $90 million.

Musk's legal representatives declined to comment on OpenAI's assertions. In a February 1, 2018, email, Musk proposed that Tesla, his electric car company, should acquire OpenAI as the only viable path forward.

However, the company rejected the proposal, leading to Musk's departure later that year.

In December 2018, Musk communicated to Altman and other executives that without a significant change in execution and resources, OpenAI would not remain relevant, emphasizing the need for billions per year immediately.

OpenAI executives concurred, leading to the establishment of OpenAI LP in 2019, a for-profit entity within the larger company, catapulting the company's valuation to $90 billion in a short span. Microsoft subsequently committed $13 billion in a strategic partnership with OpenAI.

Elon Musk's lawsuit, filed in California state court, alleges that OpenAI's collaboration with Microsoft violates the company's founding charter, constituting a breach of contract.

Musk is seeking a jury trial and demanding restitution from the company, Altman, and co-founder Greg Brockman for the profits they derived from the business.

OpenAI, initially founded to address the perceived threat of artificial generative intelligence (AGI) to humanity, established oversight mechanisms and made its product code publicly accessible.

The company, in its blog post, maintains that it remains true to its mission, dismissing all of Musk's claims. OpenAI asserts that its technology is widely available, enhances people's lives, and prioritizes product safety.

Expressing disappointment in the situation, OpenAI stated in its blog post, "We're saddened that it's come to this with someone whom we've deeply admired-someone who inspired us to aim higher, then told us we would fail, started a competitor, and then sued us when we started making meaningful progress towards OpenAI's mission without him."
